Minutes of the Municipal Council Meeting
Meeting of June 23, 2017
At nineteen p.m. on the twenty-third day of June, in the year two thousand and seventeen, the Municipal Council, duly convened, met in public session under the chairmanship of Monsieur Claude FERCHAL, Mayor.

Adoption of the minutes of the previous meeting
The minutes of the previous meeting, sent in advance to each member of the Municipal Council, were adopted unanimously, there being no observations.
Communications from the Mayor

- PCS A public meeting will be held on July 7 at 6:30pm at the Salle du Point de Rencontre to present the Plan Communal de Sauvegarde to residents.
- PLU A public meeting will be held on July 6 at 6:30 pm at the Salle du Point de Rencontre to present the Local Urban Development Plan to residents.

Mr. LAMETRIE thanks the Municipality for sending flowers on the death of his wife.
- Letter from Mr and Mrs RIVAULT
Monsieur le Maire informs Council members that a letter has been received from Mr & Mrs Christian RIVAULT, 119, Chemin Sous Les Bruyères.
Monsieur le Maire explains that the Chemin Sous Les Bruyères is regularly used by motorists at excessive speeds. This is a cause for concern, as this part of the road has not yet been restored and is limited to 30 km/h. The members of the Municipal Council decided to send a flyer to all letterboxes.
Commune 2016 Administrative Account
The 2016 Commune Administrative Account presented by Mr Philippe Lefebvre, First Deputy Mayor, shows the following results:

Revenue: €445,443.11
Expenditure: € 365,430.22
Surplus: €80,012.89
Investment section
Revenue: €185,826.86
Expenditure: €242,302.39
Deficit: €56,475.53
Total surplus :

80 012.89€ – 56 475.53 € = 23 537.36 €
Cumulative results to be carried forward to the 2017 Primitive Budget are therefore as follows:

The Municipal Council, having considered the matter, unanimously, with Mr Claude FERCHAL abstaining from the vote:
– APPROVES the 2016 Commune Administrative Account.
Grant: "Je me Souviens" Association
As part of the 75ème anniversary of August 19, 1942, Monsieur le Maire informs the Assembly that an exhibition organized in collaboration with the Association "Je Me Souviens" and the commune will take place in the Salle du Point de Rencontre from August 12 to 22, 2017. Monsieur le Maire proposes that a grant of €300 be awarded to the Association "Je me souviens".
The Municipal Council, having deliberated, unanimously :
– DECIDES to award a grant of €300 to the Association "Je Me Souviens".
– AUTHORIZES the Mayor to sign all documents relating to this grant.
– DECIDES to make the following budget amendment:
Ø D - Account 022 - Unforeseen expenditure - 300.00
Ø D - Account 6574 - Operating Grant to Associations + 300.00
Cheque acceptance: SWISS LIFE Insurance reimbursement
Monsieur le Maire informs the members of the Municipal Council that, following the glass damage to the municipal truck, the SWISS LIFE insurance company had reimbursed the repair bill exclusive of VAT. Following a claim, SWISS LIFE insurance has reimbursed the difference, which corresponds to the amount of VAT, i.e. €95.45. The Municipal Council is asked to approve the cheque.
The Municipal Council, having heard the Mayor's presentation, after deliberation, and unanimously :
– DECIDES to accept the cheque in the amount of €95.45 from SWISS LIFE insurance company
Cheque acceptance: groupama insurance reimbursement
The Mayor informs the members of the Municipal Council that :
- 1. Following the storm on the night of January 12 to 13, 2017, the public lighting lantern caps flew off and broke. GROUPAMA is reimbursing us the sum of €1,806.99, the amount of the 1era repair bill less the amount of the deductible.
- 2. Following the fire at the selective sorting containers on 1er April 2017, the expert appointed to carry out the expert appraisal operations forwarded his conclusions to GROUPAMA. After studying the expert's report, GROUPAMA sent us a cheque for €8,639.90, the amount of a first payment on the indemnity.
The Municipal Council is asked to approve these 2 cheques.
The Municipal Council, having heard the Mayor's presentation, after deliberation, and unanimously :
– DECIDES to accept cheques for the following amounts:
Ä 1,806.99 for compensation for damage to public lighting lantern caps
Ä 8,639.90 for the 1era compensation for fire damage to selective sorting containers.
Don
Monsieur le Maire announces a donation of €300 in the form of a cheque from Monsieur and Madame Philippe HERITIER in gratitude for the commune's help in the event of their loss: the roof and framework of the villa "Chante-brise" were destroyed on the night of January 12, 2017.
The Municipal Council, having heard this presentation and after deliberation, unanimously :
– ACCEPTS 300 € donation from Mr. and Mrs. Philippe HERITIER
Amendment no. 1: Fixed-term contract: Home Market
The Mayor explains to the members of the Municipal Council that :
Having regard to Law no. 84-53 of January 26, 1984 on statutory provisions for the local civil service
Having regard to decree no. 88-145 of February 15, 1988, implementing article 136 of the amended Act of January 26, 1984, concerning statutory provisions for the Territorial Civil Service and relating to contractual agents in the Territorial Civil Service
In view of Decree no. 2015-1912 of December 29, 2015 containing various provisions relating to contractual agents in the Territorial Public Service (JO of December 31, 2015).
Considering deliberation N° 2017-026 dated April 7, 2017on the creation of a fixed-term contract,
Considering the contract dated April 14, 2017 of Mr. Paul MARTIN
An amendment is required to extend the term of Mr Paul MARTIN's contract:
- Ø 3 hours on Saturdays in JULY and AUGUST 2017
The Municipal Council, having deliberated, unanimously :
– DECIDES to extend Mr Paul MARTIN's fixed-term contract by 3 hours on Saturdays in JULY and AUGUST 2017
Exceptional Grant "MARAKANA" Association
Having regard to the Code Général des Collectivités Territoriales,
In view of Ordinance no. 2005-1027 of August 26, 2005, published on August 27, 2005, reforming certain budgetary and accounting rules applicable to communes, the allocation of subsidies to associations is subject to a deliberation separate from the budget vote,
Considering that the "MARAKANA" Association is taking part in the Fête de la Musique free of charge,
The Mayor proposes to award an exceptional grant of €100 to the "MARAKANA" association.
The Municipal Council, having heard the Mayor's explanations, and after deliberation, unanimously :
– DECIDES to award an exceptional grant of €100 to the "MARAKANA" association.
– AUTHORIZES the Mayor to sign all documents relating to this grant.
– DECIDES to make the following budget amendment:
Ø D - Account 022 - Unforeseen expenditure - 100.00
Ø D - Account 6574 - Operating Grant to Associations + 100.00
Sentier du Littoral
The Chairman of the ASA de Vasterival presented to the Mayors of Varengeville Sur Mer and Sainte Marguerite Sur Mer the latest changes made by the Département to the temporary agreement authorizing the use and development of the sentier du Littoral.
The purpose of this agreement is to set out the responsibilities and terms and conditions relating to the opening, development and maintenance of the Sentier du Littoral (coastal path) on the section running through the Vasterival ASA.
In view of the latest modifications submitted by the department;
Considering that the département has not included in this agreement either the path and staircase in the Valleuse de Vasterival that lead to the beach, or the Panorama point above the cliffs
Considering that hikers will still have access to these two points, even if they are in poor condition and dangerous.
At this stage, it is not possible to sign the agreement proposed by the Department.
The Municipal Council, having heard the Mayor's explanations, and after deliberation, unanimously :
– REQUESTS that the President of the ASA de Vasterival agree not to sign the proposed temporary agreement with the Département for the authorization of passage and development of the Sentier du Littoral.
There being no further business, the Mayor thanked all those present and adjourned the meeting at 8:40 pm.
